These Terms of Service form part of an agreement (this/the “Agreement“) between Fastcomcorp, LLC, a Alabama limited liability company, (“Fastcomcorp“) and Client/Customer. This Agreement governs provision of Fastcomcorp’s services (the “Service“) and is effective as of the moment Client/Customer indicates agreement at the Fastcomcorp website or with of good standing representative of the company, as of the moment the two parties sign a agreement, or as of the moment Customer utilizes any of Fastcomcorp’s Services.

Changes to the Terms of Service and the Website

Fastcomcorp.net is a work in progress, meaning that a lot will change in the near future. We reserve the right to update the Website and these Terms of Service from time to time, at our discretion and without notice. Nevertheless, this document is public on Fastcomcorp, LLC website (fastcomcorp.net), and you will be able to track the changes for any new version. Your continued use of the Website following the publishing of updated Terms of Service means that you accept and agree to the changes.

Compliance with Law

You undertake that your use and your users use of our services that it does not and will not violate any applicable laws and that you will not permit any such violations by others.

We are not responsible for any use in which you or your users make of our services, nor any charges that you or your users may incur with a third party. You will indemnify us against any liability for any action that you undertake that does or may breach any applicable laws and any costs (including our legal fees and a commercially reasonable additional charge for our time), claims, damages, expenses, losses and liabilities resulting from such breach.

Governance and Law

Any legal suit, action or proceeding arising out of, or related to, these Terms of Service or the Website shall be instituted exclusively in the courts of the State of Alabama.

Hosting Payments

Fees are payable in advance on the first day of each billing cycle. Customer’s billing cycle shall be monthly, beginning on the Service Commencement Date. Fastcomcorp may require payment for the first billing cycle before beginning service.

The customer is responsible for providing Fastcomcorp with changes to the billing information (such as credit card expiration, change in billing address) At its option, Fastcomcorp may accrue charges to be made to a credit/debit card until such charges exceed $10.00. Fastcomcorp may suspend the service without notice if payment for the service is overdue. Fees not disputed within sixty (60) days of due date are conclusively deemed accurate. Customer agrees to pay Fastcomcorp’s reasonable reinstatement fee following a suspension of service for non-payment, and to pay Fastcomcorp’s reasonable costs of collection of overdue amounts, including collection agency fees, attorney fees and court costs. All credit card and billing information is transmitted using SSL encryption to secure backend servers. Full credit card details are not retained by Fastcomcorp.

Fee Increases: Fastcomcorp may increase its fees for services effective the first day of a Renewal Term by giving notice to Customer of the new fees at least forty five (45) days.

Early Termination: The customer acknowledges that the amount of the fee for the service is based on Customer’s agreement to pay the fee for the entire Initial Term, or Renewal Term, as applicable.

Refunds: All charges are non-refundable unless expressly stated otherwise, or otherwise provided by applicable law

Hosting Services

In exchange for the fees you pay in advance upon the creation of your hosting account with us, we will host your applications and site on one or more of our servers, so long as you abide by the terms and conditions that are set out on this page, and in any other agreements that relate to the services we may provide to you. We will provide the services according to the specifications listed for the hosting package you select during the signup process.

SSL Products Return and Exchange Policy

We issue store credit, exchange or refund request by the account holder anytime up to 30 days after product issuance. To inquire about getting store credit or refund, it takes 72 hours to process.

Terminating our Hosting Services

We are constantly changing and improving our Services. We may add or remove functionality or features, and we may suspend or stop a Service altogether. You can stop using our Services at any time, although we’ll be sorry to see you go. If we discontinue a Service, where reasonably possible, we will give you reasonable advance notice and a chance to get your data out of that service.

User Content: Responsibility and Ownership

Customers are responsible for all content and activity that occurs under their account. This means as a customer you need to ensure that all of the content on your cloud/server’s complies with all applicable laws and regulations, including (but not limited to) U.S. copyright law. Fastcomcorp does not prescreen content to ensure compliance, but we do have the right (but not the obligation) to refuse or remove any content that is available via the service, at our sole discretion.

Warranties and Disclaimers

Fastcomcorp’s hosted application services is provided on an “as is” and “as available” basis. We do not guarantee and are not liable for any failure to access or store your data on your cloud/servers at any time. Like all cloud-based applications, we are vulnerable to the inherent unreliability of the internet.
